El-Rufai sues Kaduna lawmakers over N423b fraud claim

For being indicted for N423 billion fraud by the Kaduna State House of Assembly, the immediate past governor, Nasir el-Rufai, yesterday, dragged the lawmakers to the Federal High Court, Kaduna, for allegedly violating his fundamental rights.

The applicant is seeking the court’s remedy over what he considered as the House’s unconstitutional action.

In the suit, el-Rufai said he was denied the right to fair hearing in the proceedings leading to submission of the report indicting him of fraud.

His lawyer, Abdulhakeem Mustapha (SAN), said el-Rufai approached the court as a Nigerian citizen, who is entitled to be given a fair hearing before his rights can be determined by an investigative body or court.

According to him, this is in line with the provisions of the 1999 Constitution (as amended) and the African Charter on Human and Peoples’ Rights.

The plaintiff urged the court to declare the report as unconstitutional, null and void for violating his right to fair hearing as guaranteed under Nigeria’s Constitution.

A date is yet to be fixed for hearing of the case.
